Several years ago, before the Department of Homeland Security (DHS) and Immigration and Customs Enforcement (ICE) were inspecting criminal records of immigrants, a conviction would not cause a problem until someone applied for immigration benefits or travelled outside the U.S. as a resident and were inspected at the border upon re-entry.
Now upon arrest of an immigrant, ICE is notified and referral to an immigration judge for deportation or removal is the result. This can occur as a result of a mere traffic stop or other matter.
Our lawyers advise immigrants BEFORE they work out a possible guilty plea that will not result in the above.
